Vital Loop (Pty) Ltd (also referred to as just "Vital Loop"), provides you with access to our marketing website at www.vitalloop.co.za ("Website") and our web application ("Web App"), subject to the following Terms of Use.

Please read the Terms of Use ("terms of use", "agreement") carefully before using the Vital Loop Website and Web App (collectively, "the Service") owned and operated by Vital Loop (Pty) Ltd ("us", 'we", "our").

This agreement is an understanding between Vital Loop (Pty) Ltd and the user of the Service, and this supersedes and replaces all prior agreements regarding the use of this Service.

About the Service

The Vital Loop Website provides information relating to our company and the services we offer.

The Vital Loop Web App is a service used to help users track chronic conditions, such as diabetes. Users can use the Web App to log personal health information, such as blood glucose readings.

Our Service facilitates the collection and viewing of your personal health data. You control your data and can choose when and if to provide it to your doctor or other healthcare provider.

As a company, Vital Loop (Pty) Ltd and its employees are not involved directly in the delivery of healthcare services, providing medical advice, or treating patients. The Service is an information tracking tool, not a medical device or a substitute for professional medical advice, diagnosis, or treatment.

If you are a patient seeking medical assistance or advice, please do not seek it through the Service. You must consult a qualified Healthcare Worker or visit your local Health Facility so they are able to advise on treatment and make referrals as required.

Service Content

Vital Loop (Pty) Ltd endeavors to always ensure that all information provided on the Service is accurate and up to date, but it is understood that accidental errors in content may occur. You agree that Vital Loop (Pty) Ltd cannot be held liable for any damages resulting in any accidental errors or omissions in the Service's content.

We may modify any of the Service content, including this Terms of Use or the Vital Loop Privacy Policy, at any time without notice. The new content will be effective upon its posting to the Website. Your continued use of the Service constitutes your acceptance to the updated Terms of Use or Privacy Policy. Vital Loop (Pty) Ltd, has the right, but is not obligated, to strictly enforce the Terms of Use.

We respect your privacy and will only collect, process, store or share Personal Information when legally allowed to do so.

By contacting us via this Website or by registering for and using our Web App, you are consenting to us collecting and processing the Personal Information you have provided to us. This includes information provided during your WhatsApp-based registration and health data (like blood glucose levels) that you voluntarily track in the Web App.

We may use anonymised and aggregated data, from which all personally identifiable information has been removed, for research purposes. We will not disclose information that can lead to the identification of individuals, except as required by law or as detailed in our full Privacy Policy.

Your data is stored securely using top-tier database providers like Supabase.

User Submissions

You must not submit any personal health information or other sensitive data through the general contact forms on our Website. The Web App is the designated platform for tracking your health data.

You agree not to transmit to Vital Loop (Pty) Ltd any information or post, email, or otherwise make any Submission that:

(i) is unlawful, harmful, threatening, abusive, harassing, defamatory, libellous, invasive of another's privacy, or is harmful to minors in any way;
(ii) harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
(iii) impersonates any person or entity, including, but not limited to, a Vital Loop (Pty) Ltd employee, or falsely states or otherwise misrepresents your affiliation with a person or entity;
(iv) that includes personal or identifying information about another person without that person's explicit consent;
(v) is false, deceptive, misleading, or deceitful;
(vi) infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
(vii) that constitutes or contains "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement;
(viii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(ix) disrupts the normal flow of dialogue with an excessive amount of Submissions (flooding attack) to the Service, or that otherwise negatively affects other users' ability to use the Service.

Additionally, you agree not to:

(i) contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose;
(ii) "stalk" or otherwise harass anyone through the Service;
(iii) collect personal data about other users for commercial or unlawful purposes;
(iv) use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the Service;
(v) attempt to gain unauthorized access to Vital Loop (Pty) Ltd's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of, the Service.

Vital Loop (Pty) Ltd may refuse, delete, or remove any Submissions at any time for any reason and may terminate your access to our Service at any time for violation of these Terms of Use or any other reason.

Vital Loop User Accounts

To utilise the Vital Loop Web App, you are required to register for an account. Registration is initiated via the WhatsApp messaging service.

By registering, you consent to us communicating with you via WhatsApp. This includes sending you a "magic link" to access the Web App and sending periodic reminders to use the app or other service-related messages.

You are responsible for ensuring the accuracy of the information provided during registration. You are also responsible for maintaining the privacy and security of your account, including the confidentiality of any magic links sent to your WhatsApp number. All activities that occur under your account are your responsibility.

We take reasonable measures to secure your data, including using established third-party providers such as Supabase for our database infrastructure. However, no method of transmission over the Internet or method of electronic storage is 100% secure.

If you believe the security of your account has been compromised, please inform us immediately at support@vitalloop.co.za.

Vital Loop (Pty) Ltd reserves the right to edit, modify, and change these Terms of Use and our Privacy Policy from time to time.
